Will
A Will is a legal document that sets out your wishes for how your property, assets and personal belongings will be distributed after your death. It can also appoint guardians for children and make other personal arrangements.
Power of Attorney
A Power of Attorney is a document where you appoint someone to manage your financial and legal affairs on your behalf — for example, if you are unwell, travelling, or unable to manage your affairs yourself.
Enduring Guardian
An Appointment of Enduring Guardian allows you to nominate someone to make decisions about your health, medical care, lifestyle, and personal matters — if you are ever unable to do so yourself (for example, through illness or incapacity).
Probate
Probate is the court process that confirms a Will is valid and authorises the executor to administer the estate — this means collecting the assets, paying debts, and distributing inheritances.
Letters of Administration
If a person dies without a valid Will, the court can grant Letters of Administration to an appropriate person (usually a next of kin), who will then manage and distribute the estate according to law.
