Why Legal Advice is Essential
In NSW, surrogacy is governed by the Surrogacy Act 2010 (NSW). Even when all parties agree and have the best of intentions, the law requires independent legal advice and a formal written agreement before conception occurs.
A parentage order must be sought through the Supreme Court of NSW after the child is born to legally recognise the intended parents. This process is sensitive and time-bound, and our team ensures all necessary requirements are met.
